County employees cleared of negligence charges

Winona County officials have been cleared of any negligence in the deaths of a Witoka couple during the flooding of 2007. The Honorable Judge Jeffrey D. Thompson dismissed the case brought by Billy Gensmer against the county. Gensmer's parents, Victor and Joyce Gensmer were killed when their car went into a washout on County Road 17 caused by floodwaters. Documents show Gensmer was seeking $100,000 in damages and accused several county employees including county highway department crews, Sheriff Dave Brand and emergency managers and Highway Department employee Kevin Lindquist of negligence saying they new the road was washed out hours before the accident occurred and failed to take precautions.
